These Terms of Service (“Terms”) govern your use of the Nelio A/B Testing application for Shopify (the “App”), which is part of the services (“Services”) provided by Nelio Software, S.L. (“Nelio”, “we”, “us”, or “our”).
By installing, accessing, or using the App, you (“Customer”, “you”) agree to be bound by these Terms, our Common Terms & Conditions, our Privacy Policy, and our Data Processing Agreement (DPA), which together form the agreement between you and Nelio.
1. Description of the App
The App enables Shopify merchants to create and run A/B tests, analyze user behavior, and optimize their online stores through experiments and data-driven insights.
Features and functionality may evolve over time and may vary depending on the plan selected.
2. Access and Use
You must have a valid Shopify account to use the App.
You agree to use the App only in compliance with applicable laws and Shopify’s terms and policies.
You are responsible for all activity conducted through your Shopify account in connection with the App.
3. Billing and Subscription
The App may be offered on a subscription basis.
All fees are billed and processed through Shopify in accordance with Shopify’s billing terms. Nelio does not directly process or store payment information.
Subscription charges, renewals, and billing cycles are managed by Shopify.
4. Cancellation and Termination
You may cancel your subscription at any time through your Shopify account.
Cancellation will take effect at the end of the current billing period, in accordance with Shopify’s terms.
Uninstalling the App from your Shopify store will result in termination of your access to the App.
Nelio may suspend or terminate access to the App if you breach these Terms or misuse the App.
5. Data and Privacy
In providing the App, Nelio may process store-related data as described in our Privacy Policy, and Data Processing Agreement (DPA).
You are responsible for ensuring that your use of the App and any data processed complies with applicable data protection laws.
6. Relationship with Common Terms
The use of the App is also subject to our Common Terms & Conditions, which include provisions on limitation of liability, disclaimers, intellectual property, and governing law.
